Surely it wasn't anything more than being "wanted for questioning". In which case the LEO's were just doing their jobs and following up on a report of trespassing. How are they supposed to know if it's true or false without talking to him if they haven't even figured out what the internet is yet?

Your post was only meant to stir the pot JD. We did nothing illegal and your comparison of the hover craft would have been illegal as the airspace above ones property is also their real property. You seem to think that you know a lot more about the law than you actually do. Is your last name Prater?

Can't say I disagree with much here. I just want people to know what kind of impact that taking a fish like that out of one of these streams would have before they do it.

That's a good theory. But how do you explain the 20(+) inchers that we have seen come from those stream "Xs"? Also, I don't know about you but I want the fish that did make it to 18" to spawn that final year. It still makes me sick to see people keep fish like that.

I believe that if someone interferes or harasses with a person fishing within the banks of a stream or river that has been accessed in any legal manner, including but not limited to a public access administered by the Missouri Department of Conservation, then the harasser/interferer should be punished to the fullest extent of the law. The state of Missouri has laws in place to keep this from happening and yet it still happens all the time. The only way to stop this type of harassment and intimidation is to punish the law breakers. This stream, Shoal Creek, has obviously been deemed navigable by someone in the higher powers of the states government, or the MDC would not have put a public boat launch on the stream in order for the public to navigate it. I, Jason Carroll, a resident and taxpayer of the state of Missouri, demand that something be done in order to correct this wrong doing and to insure that it does not happen again.

Oh and did you get any of the ones that Tony took? Anyone else have any fish pics from the float to loan out?

Good to note that the picture of Chief above cleary shows him inside of his boat on the gavel bar Prater thinks he owns.

Also, if there is not a warrant, which I don't see there actually being one, spreading a rumor of that sort could really compromise ones character. I would get him for slander/libel.

I believe it. (that Prater said it) My goal tomorrow is to get a contact within MDC that would be good to report Prater to for harassing us while we were legally fishing.

I caught that also, Mic but am not sure that is what the author meant to say. If is the low water mark you could be wading normal flow and still be trespassing. Additionally, unlike the visible high water mark, there is no way for the angler, land owner, law enforcement or MDC agent to know where the low water mark is. I think that is a typo and have been trying to find contact information for the author. If I can't find his contact info I will send an email to an MDC official asking clarification.

You hit the nail on the head. Almost. In speaking with the sheriff, I now feel that it is more then young gun deputy (along with the land owner) that needs to quit trying to throw his weight around and learn the law. If he was so sure that he was right he would have ticketed me after I told him I was out of the water previously and then called his bluff.
