Danoinark Posted August 17, 2006 Posted August 17, 2006 This is posted by Greg on John Wilson's Board and its good news..Greg gave me permission to post it here....Dano I'm an attorney, and I represent the Arkansas Council of Trout Unlimited ("TU"). Yesterday, we served the developer of Overlook Estates with a notice of intent to sue under 33 U.S.C. 1365 of the Federal Clean Water Act. Pursuant to that statutory provision, TU will sue the developer in an appropriate United States District Court in 60 days unless he remedies the situation in its entirety during that period of time. If the ADEQ files suit against the developer during that 60-day period, then TU would not be able to file a separate suit but would seek to intervene in that suit.
