I'm an attorney, and I represent the Arkansas Council of Trout Unlimited ("TU"). Yesterday, we served the developer of Overlook Estates with a notice of intent to sue under 33 U.S.C. 1365 of the Federal Clean Water Act. Pursuant to that statutory provision, TU will sue the developer in an appropriate United States District Court in 60 days unless he remedies the situation in its entirety during that period of time. If the ADEQ files suit against the developer during that 60-day period, then TU would not be able to file a separate suit but would seek to intervene in that suit.

This thing is about to be taken to the next level.

This is good news. This is exactly what needs to happen to get Benny Doyal's attention. Let's see what ADEQ does. This is definately a great start.
