Well after a few years of creating many of my own designs mostly experimental or buy mistake, and reading a few other other recent posts. I was wondering if anyone here would like to shed a lil more light on the subject. In the way of how to or there ventures into the possibility of legaly being the offical daddy of your own pattern ?

Patent is almost impossible, given that flies are largely derivative.

What the major fly companies, like Umpqua Spirit River etc, is trademark your name _ like the "JJtroutbum Midge" take ownership of the name of the fly and pay you a royalty for selling that fly under your name.

Umpqua ten to finalise their selections 2 years out in august, ie in August this year they will be selection 2008 patterns they require 6 tied flies in each color and size variation, plus details etc of materials. Then you take your chances not only on what works but what they think will sell and what they need in their fly offerings.

On the Other hand if your not in it for the money, simply posting it here (or a magazine would be enought to give you intellectual property rights) _ about all that would get you would be the name. Which basically means that other fly fishers know it by your name, and perhaps even that you came up with it.

What Steve posted is right , forget it, l have a ton of flies out there that I have innovated over the years produced by commercial companies.

They pay me a royalty check each month for the percentage of sales they make for those flies.

If you have innovated something you believe is unique, publish it before some one else comes up with something similar.
