My understanding of the situation is that the Judge has to grant the State permission to enter the property to do the work. My biggest fear is that the developer will go belly up before he has to pay for this environmental catastrophe.

If the Fed's get involved they might just go for some prison time with a large....... $ fine to boot! They have been known to go after the BIG guys to show they mean business!!!

They ought to throw him in that prison in Calico Rock, that way he is forced to work on the chain gangs that I see cleaning up area parks and access areas along and near the river. That, along with his financial and personal ruin, would be a fitting punishment if you ask me!

Bankruptcy laws are such that he may still have to pay for the damage.

I know someone who had a large judgement and the judgement was set aside by the court. The person had tried to file 11 and get around it but judgements can be held accountable.

The developer should have some type of insurance or paid a bond.

Next is to find out how they evaded the bond.

My mother sold 10 acres in Harrison AR. maybe the highest 10 acress, just off the coner of Bunker and Cottonwood, the people put in condos and had some big hoops to jump thru for the state, to include construction and future runoff by building a holding pond.

When I saw the mess at overlook a few months ago, I wondered who allowed the idiot to scalp the hill.

Now can the EPA not be called in to help in this?

Usually Court judgements are not cleared by bankruptcy. I assume he could file before the final disposition in the Circuit Court. This is going to be an interesting turn though. It sure won't be settled on March 16.

The govener is having a call in show tomorrow. Someone with the overlook knowledge should call in.

Dano, that section matter of fact most of the land in that area was homesteaded by my ancestors.

The old white house on top of the 2nd hill out Cottonwood rd was built 2 years before the civil war by my ancestors. Event he old Cemetery another 1/2 mile out was started by my great, great great grandmother.

Those condos took my squirrel woods. Just before it sold I was able to get one last Wood duck drake from the pond thats nolonger there.

Things change thats why I now live in Newton county!!!

New York City Fined $5.2 Million for Muddying Esopus

According to the Associated Press, "The U.S. Supreme Court declined Monday to hear an appeal from New York City in a lawsuit by sportsmen and environmentalists upset over silty water added to an upstate trout stream that carries part of the downstate water supply." Some reports, however, indicate that the muddying of the Esopus may continue since some sort of permit was issued in response to a challenge by a coalition of fisherman and clean water advocates.
