Two of my sons were wade fishing Jekins creek Sat. Landowner came down and started screaming and cussing to get off his land, (they were in the water). The started wading back to the bridge with him cussing all the way. He called the sherrifs dept. and they responded. Son was on the phone to the MDC agent and he told him that they were not tresspassing as that is floatable water where they were. he could not come down there as he was busy but said he would have liked to to set the landowner straight. The sherrifs dept went ahead and wrote tickets for trespass as they were not sure of the law, and they said it probably wouldnt get across the prosecuters desk and they have had alot of calls from this guy. So watch out on Jenkins Creek.

Bummer. Big thumbs down to cranky landowners who think they own navigable waterways.

I've had a similar confrontation on Little Piney. Its navigable much of the year, and a publicly managed trout water. If any commercial activity has ever occured on a stream, its considered navigable. I know at least one guide takes clients on the Little Piney, so that should make it considered navigable in itself, besides the fact that it is often actually navigable.

Denjac... same thing happened to me on Roaring River outside of the park. At least the gal was cordial, but agitated. Tim from the fly shop responded to my post and said where I parked and waded up was a local swimming hole all summer. My in-laws lived on the lake by Viola until we moved them to Cassville three weeks ago. What part of Jenkins were your boys wading and is the smallmouth and goggleye fishing good? I've floated Flat Creek from the 39 bridge down to EE and did real good. Want to float from EE down to the lake sometime, figure there'd be some nice smallies that stretch. Give me a holler about Jenkins...

Was there any signs posted in that area?

Should have gave the cell phone to the Sherrif to talk it over with the MDC agent.

There were just south of I44 by the old settlers picnic grounds. I know Felix real well and all I would have to do is call him and fish on his place, if I could ever get ahold of him. Hes gone all the time. Boys thought the trouble makers name was Fasken, but they are not 100 % sure. Guess he made an butt of hisself in front of the cops. Oh by the way they did catch some smallies, all dinks. They were mainly fishing for bait for there limb lines.

I was wondering what a trespassing ticket runs these days????

I bet if your boys went to court they might be able to get that agent to show up and put this whole thing to rest. Did they say what the agents name was? We met one Sunday morning near Shoal Creek and he was based in Jasper County, but is helping out in Newton until the new guy gets here in October. He gave me his number and I won't hesitate to call him. I guess the new guy for Newton County is young and pretty aggressive, which will be good for us and bad for lawbreakers. It really is amazing to me how many landowners don't know the laws and yet the cops don't bother to know them either. I would think if this guy was making so many calls, someone ( the Police ) would look into it and save the courts a lot of wasted time.

If fishing was easy it would be called catching.

I know right were you are speaking of. Were they on the south side of the old Hwy Bridge? I was on the north side last year and actually standing in the field and Dylan was at the water. The owner drove up and was very, very nice. Asked that I don't leave any trash. I told him I wouldn't even leave a foot print behind. He smiled great big, gave a big wave and drove off to house across the bridge.

I think if it goes to court they plan to ask him (the MDC agent )to show up. Not sure what side of the bridge they went on. Thanks for the info chief I forwarded it on to the boys.
