Looks like the state and this guy will fight it out as the river dies a slow death. I just can't believe that there is nothing that can be done to stop this problem right now. This is a disgrace to the entire state of Arkansas. I was fishing last weekend in the Moccassin Creek C&R area on the White and watched as the nasty Norfork water made its way down and muddied the river up and shut down the fish. This guy is not only destroying the Norfork but also putting the White below the confluence in serious danger as well.

I suppose that there is a lesson here for all states, if this was crminial by statue, it would be addressed a lot sooner.

My advise is to get the EPA into it. I bet they don't know about it. And I do know that it is public water way and they do have a say. They will fine the heck out of this guy and no town or county politics either. Might be worth a shot. Ron

MTM, With all due respect. The EPA is a joke. Come to NE Oklahoma and take a look at one of the top ten superfund sites in the USA. Millons, and I mean more than 50 were spent to remediate, so the people could live in this one town. Now, after nine or ten years of spending your tax dollars to remediate, they have decided that it is still to dangerous for the people to live there. Now, they are going to spend more of your tax dollars buying these people out, so they can move to another area. But then again, that is just my two cents worth. I know you are not implying that the taxpayers should fix this, BTW. I really don't think it should be the taxpayers burden to fix the problem at Overlook Estates. I do however think it will be the taxpayers problem, though. This guy is going to fold up shop at head South with his money, and I mean way South. My guess is, most of his money is already there, since they bent over backwards to let him try and fix it. They gave him enough time to come up with a plan.

Could it be a county thing... in Missouri, alot of counties are implimenting planning and zoning regulations and although they are a pain to builders, can stop alot of the stupid things contractors do... and at the county level, rules can be enforced without red tape.

Have the county officials been involved in this at all? Do they care?

I don't think Baxter County has local zoning laws or ordinances. I do know the city of Norfork did pass a resolution against the development....Dano

The way I look at this is that it needs to be fixed and it dosen't matter much right now who pays for it. The law suits can follow but the river needs to be fixed right now. Later may be to late. It is an election year maybe people need to call or write there Congress men and woman or other government people. There are also some national River Org's that may help. I do not live there and believe it or not the Yellowstone River that I live on is on the 10 most indangered list do to all the building going on. Funny thing is that a lot of the people doing the building are against anything and everything that may have to do with logging, the wolves that are killing ranchers cattle, the buffalo that are over populated for the range thay are on, and anything else to do with the out of doors here, but god forbid you tell them what all the building they are doing on the river is doing to it. Or what the run off from there lawns and car washing and on and on is doing to the river. Kinda funny.

Park County the county I live in didn't get any rules in place to protect things until it was almost to late. Looks like the same thing is going on there.

I don't live close so I can only do so much but I have written the Governor's office and the local's Not much more I can do. I will do what I can. We all need to do that much. Ron
