But as Gary notes in his post the groundwork is done, only the details of how much remains to be determined. At this stage I think the important point is that Homeport has essentially admitted culpability by the settlement. Whatever you do don't take my opinion as gospel however! If Doyal fails to carry out the measures in the decree, state agencies will be allowed on the site to perform the work and may seek costs and damages for their expense, according to the decree". Does this mean they don't have to seek costs and damages if they don't want to?

From dictionary.com definitions for "may"... "To be obliged; must. Used in statutes, deeds, and other legal documents."
