Randall Posted February 16, 2006 Posted February 16, 2006 My suggestion: Big Old honking signs at each river access touting in effect the illegality's of shuffling. And that at anytime an MDC agent may be watching and you are subject to being fined. Sometimes just the "threat" is as good as it actually happening. Course MDC would have to check in every once in a while to carry through. Dano Did I get my permit, uh, Did I????? the only real problem i see with that is if an agent is crabby or doesn't like someone, they could ticket them for any type of foot movement in the water, or (as i regularly do at outlet 2) having their fly at their feet waiting for the hole to open up for a cast. its a great idea, it really is, but its waaay too vague. and based too much on personal judgement. Cute animals taste better.
Root Admin Phil Lilley Posted February 16, 2006 Root Admin Posted February 16, 2006 and I could bring a wall of amps down to the river that would be so loud that it would literally peel the skin off your forehead as you were trying to fish. That would be a kodak moment- the expressions on faces when the first cords were struck. the only real problem i see with that is if an agent is crabby or doesn't like someone, they could ticket them for any type of foot movement in the water, or (as i regularly do at outlet 2) having their fly at their feet waiting for the hole to open up for a cast. its a great idea, it really is, but its waaay too vague. and based too much on personal judgement. It's not the agent you have to be concerned with... it's the judge. From both perspectives, the judge makes or breaks laws. If he doesn't think the law has merit, he won't be tough on people. Case in point, a judge that think it's hard to tell the diff between a spotted bass and largemouth- he isn't going to be hard on the person standing in front of him if he can't tell the diff himself. I know you're going to say he is to uphold the law (MDC codes) but we're talking reality, not "the way it should be". It happens- it happens in Taney County!
Danoinark Posted February 16, 2006 Posted February 16, 2006 And Phil it happens in All Courts, down this way too. It has to start in your legislature. There has to be manadatory sentencing guidelines before it will work. Don't count on any of that happening. ..Dano Glass Has Class "from the laid back lane in the Arkansas Ozarks"
Randall Posted February 16, 2006 Posted February 16, 2006 even if the judge won't fine the person, most people would just pay the fine rather than deal with the hassle of going to court. if the judge threw the case out, its still a pain to go to court... take time off work, or whatever else you're doing, possibly hire a lawyer (some people would), then sit in court and wait your turn. if the judge hates shufflers, he might not listen to the defense given either, his mind already made up. in my very limited experience with judges though, they are fair, and unbiased. granted there are exceptions, but there always are. the problem i was pointing out was more about the agent being a d*** than guilty people getting off. both are real possibilities, lilley's is a bit better of a point. Forsythian Posted February 16, 2006 Posted February 16, 2006 But where does it end? I couldn't agree more tippet... I say do what you gotta do to protect the resource, but leave the Oprah Winfrey stuff at home please! Cenosillicaphobiac
Root Admin Phil Lilley Posted February 16, 2006 Root Admin Posted February 16, 2006 Oprah Winfrey stuff??? I guess I'm not in the know like Forsythian.
Forsythian Posted February 16, 2006 Posted February 16, 2006 ;-) it's good drama! but who wants drama on the river? Cenosillicaphobiac
jscheetz Posted February 17, 2006 Author Posted February 17, 2006 Drama?? That's why I fish - every time I hook a good fish there's lots of drama in there for me!! Life is pretty mudane without a little drama - "Scared of yellow" - well, that's not exactly apples to apples - I mean unless he's waving his yellow hat in your face You don't have to look at the yellow guy. Can't get away from Mr. bigtime blowing his smoke in my face. Dano swears you are not going to blow smoke on me tippet - so I take him at his word But just for the sake of our "class" would be good to mention it to some people who may not be so sensitive about others. Not that I think of it - sometimes outlet #2 does start to look a bit like a Oprah audience. jscheetz Posted February 17, 2006 Author Posted February 17, 2006 OK - I know I already listed my suggestion, and I have brought this up before, but maybe someone new will read this post and "get it" - I would love to see a closed season on Browns over 20" during the fall spawn. It seems that they are way too easy to catch and congrugate in great numbers below the dam. So why not just make it illegal to keep the big ones in the fall when they are the most vulnerable? OK - for those of you who are tired of hearing my say that - thanks for putting up with it. Danoinark Posted February 17, 2006 Posted February 17, 2006 JS And the 20" something Brown rule I could certainly live with and also promote. There would be nothing wrong with a reg like that. Dano Glass Has Class "from the laid back lane in the Arkansas Ozarks"
