S&M Posted February 18, 2011 Posted February 18, 2011 Is it against the law to alter or change, an active waterway that feeds Lake Taneycomo ? If so, what agency to contact to file a report ? How do I deal with those who ignore the 50 yard encroachment rule?......I show them just how accurate I am with a crank bait!
Outside Bend Posted February 18, 2011 Posted February 18, 2011 I believe there's a permitting process involved, you may want to contact the state DNR or EPA office for help. <{{{><

Thank you for your suggestion. I will pursue that avenue to correct a wrong that has been done to Lake Taneycomo. All the best to you and yours. fozzype Posted February 19, 2011 Posted February 19, 2011 Thank you for your suggestion. I will pursue that avenue to correct a wrong that has been done to Lake Taneycomo. All the best to you and yours. The EPA and DNR only deal with pollutants and/or sediment containing pollutants. The DNR or EPA have no control over the actual body of water. EPA delegates the majority of its authority to the DNR at the State Level. It is only illegal to alter a stream that is considered "navigable" by the Corps of Engineers and they have authority to enforce the regulations associated. "Navigable" has nothing to do with boat traffic and a map of the waters is available by the Corps of Engineers. You would need to contact the Little Rock office. However, the Corps solution can sometimes be worse than the problem. B. Foz
Njardar Posted February 19, 2011 Posted February 19, 2011 The Corps often uses the term "unamed tributary to" [insert lager body name] to regulate things as small as drainage ditches at construction project and small stream. The term navigable has a very broad legal definition. - Charlie
Chief Grey Bear Posted February 19, 2011 Posted February 19, 2011 I haven't read the exact law but, it is my understanding that you are not allowed to alter or impede the flow of any water way without the proper permits. You might ask the local MDC agent who you should get in contact with. Take plenty of pictures to send with your correspondence. laker67 Posted February 19, 2011 Posted February 19, 2011 It would be more helpful to know where and what. Is it fall creek?
jdmidwest Posted February 19, 2011 Posted February 19, 2011 DNR issues permits for the gravel mining of the stream banks of Missouri. Active digging in a stream is covered by that. Here is a link to the page. Mo DNR. "Life has become immeasurably better since I have been forced to stop taking it seriously." — Hunter S. Thompson
S&M Posted February 19, 2011 Author Posted February 19, 2011 It would be more helpful to know where and what. Is it fall creek? The west bank of lake taneycomo about a 1/4 mile down stream from table rock dam, the natural creek is located between a campground with electrical hook ups and a building that is all boarded up. It looks like they are starting something on the bank of the building that is all boarded up. The campground recently finished putting rocks on it's bank so I'm assuming the rocks in the creek came from them. I always stopped and fished infront of that creek because it always had flowing water coming from it. It was a killer spot when no current was flowing from generation at table rock. I beached my boat last week and climbed up the rocks to take a look. What I saw was someone had filled up the natural creek with pretty big rock, 2 and 3 foot sized rocks, choking off the creek. The creek is nothing more than a beaver dam now. Maybe this is nothing more then a storm water creek, but it doesn't make sense to me that someone would dam it up ? How do I deal with those who ignore the 50 yard encroachment rule?......I show them just how accurate I am with a crank bait!

Thanks but I am lost. 1/4 mile below TRD would be the big hole. No creeks or building there that I am aware of.
