But I will say this: The legislature and the Courts today would NOT BE ON OUR SIDE on this one. We would lose, clear and simple. Anyone who wants to push this to a ruling, either by action of a court or, worse, the General Assembly, in my view is extremely foolish. A likely outcome in the courts would be a ruling more favorable to landowners. If the Legislature got a hold of it, all sorts of stupid crap could be thrown in there. This is classic ain't broke don't fix. Of course harassment is uncalled for, but you as floater are the guest of the landowner. So if the landowner wants you gone you git. To try to press it and assert more rights in my opinion is to invite "clarity" via a ruling or worse a law, both of which in this political climate would very likely be a loser for us. My two cents. Wrong. You are a guest of the public, and as such, have just as much right to wade and float the stream in question as the landowner. . Andy

Buzz Posted April 23, 2011 Posted April 23, 2011 Something a lot of people don't understand is that Shoal Creek does not get the same kind of canoe pressure that some of the other creeks and rivers get. It's nothing like the Elk, Jack's Fork, or any of the many other rivers that you all may try to compare it to. It's just not in the same catagory. In 30 years of floating and fishing Shoal Creek I have never once seen the party floaters. You will see families who are just enjoying the warm days on the creek and also floater/fishermen enjoying the great fishing experience. Never the rowdy bunches of idiots that give most rivers a bad name. When a landowner buys land, or in this case inherits or is waiting to inherit land, and then begins to harrass people for no good reason it is just wrong. That is truly the case here. Nothing more, nothing less. If fishing was easy it would be called catching.

I had a lot more colorful and descriptive report typed up but luckily in the time it took me to find my misplaced camera for the pictures I talked to the sheriff as did Duane and Chief and had time to cool off so I retyped it andtoned it way down. Monday I thought I saw a campground on Shoal Creek along 71 hwy. where the creek runs under the freeway N. of Neosho a bit (or was I just seeing things??) Yes there is a campground/RV park on Hwy. 71 that runs right up to Shoal Creek. They have built a pretty good sized lake and charge a pretty penny to fish it. I also believe they are charging to use their property to get to Shoal Creek to fish. Thank you. Yeah you were very professional. I liked the title, and especially liked the picture with me in the foreground and the county mounties in the background. How about sending that to me??? It would make a great screen saver. I had a pretty good letter written up that I was going to hand deliver to Sheriff Copeland and the prosecuting attorney, but Chief called and told me about his meeting and said it wasn't necessary.BTW, you were quoted. I am so glad we have a supporter in this county. I won't do anything different than I ever have, but I know now that I don't have to put up with their crap either. Mr. Kenneth Copeland will definitely get my vote. If fishing was easy it would be called catching.

And you can pm me your email our just click on the picture and then when you are on the screen of that pic only just right click and "save image as". ColdWaterFshr Posted April 23, 2011 Posted April 23, 2011 If a feller who doesn't know any of you all, and who didn't sign no petition and never left no voicemails to a Constable Copeland. . . were to put in at Lime Kiln . . . just how far down and on which side of the river might he find himself in Praterville? Gonna laminate me some Elder vs. Delcor, pack the sidearm and my pitbull and plan a float with reststops and peebreaks at every gravel bar between there and Tipton Ford.
