bigredbirdfan Posted August 5, 2011 Posted August 5, 2011 Bingo. I try to stay out of these cop discussions as common sense tends to go out the window. This one seems to be fairly tame! He did possess by taking a photo of it. I can even give you a good idea of the Officer's testimony. We had received information of illegal spoonbill snagging at this location. Myself and another officer decided to watch the area and see if it was in fact accurate information. I saw the defendant snag a spoonbill. He did not leave the fish in the water or release it immediately, but POSSESSED it as he took a photograph of it. He did not stop snagging in the area where he now knew there were spoonbill, but kept snagging. As a matter of fact he did not move to another location. Not only did he snag three more spoonbill for a total of four, BUT he even called over another guy to let him reel one in! I already tried to give him a break by not citing him four times or citing him for the largest fine I could, but gave him a lesser ticket. I tried to cut him a break as he said he was trying to snag gar, of which I didn't see any. Good luck on the ticket!

He did possess by taking a photo of it. Ehh, do I possess it by having a hook in it too?? I highly doubt the Agent would have ticketed him if he had just snagged one, even if he would have taken a picture. But it went well beyond that. He wouldn't stop. And as we can tell by his posting here, I would suspect that the agent may have even tried to give him the benift of the doubt and he got mouthy and a ticket. At any rate, I think in the intent of the law, one would have to put it on a stringer, basket, livewell or such. emjay Posted August 6, 2011 Posted August 6, 2011 My brother once got a ticket for "possession of fish without a fishing license" for bringing my stringer back to the car. He just called the court/judge and explained the situation and the ticket was thrown out.
405z06 Posted August 10, 2011 Posted August 10, 2011 And since season has ended, i have snagged a lot more than 4 of them! Prolly close to 35 or 40 and only caught 4 gar! But that is besides the point, they are in there and they get hookes, quite often! This is my favorite part. He goes gar snagging and grabs 10x as many paddlefish as gar. Ridiculous.
