I talked to a game warden/conservation agent weekend before last while wading by the slab over at John's Ford on the upper Finley above Linden about 6 or 7 river miles. We talked a little bit about stream access and navigable vs. unnavigable, he said the Finley is definitely considered a navigable stream by his department, and he seemed to be on the angler's side when it comes to stream access overall--We discussed the Beaver and Swan also.

So I wouldn't give two sh**s about those signs. In my opinion.

So I've been talking to a couple of my Christian County deputy friends and they said it's not legally enforceable, they aren't looking forward to getting calls from the residents about it, and they don't know how they got the no trespassing signs that say Christian County Sheriff on them, but they didn't come from the sheriffs dept. Fish all you want. :yaeh-am-not-durnk:

now that I think about it, it was a strange sign. It said no trespassing, in cooperation with the land owners, or something like that. Someone went to a lot of trouble spray painting those boulders though.

It's the Linden Land Owners Association. They have a gated driveway over on 125 west of the bridge. Mostly weekend homes. My uncle owned a place in there up until a few years ago and I heard all about their hatred of the weekend warriors at Linden.

I haven't been down there to see the spray paint, but I know where the boulders are, and they're insane if they think they have the right to keep people out of the creek. Especially right there below the dam!

Can't blame those land owners for trying. There is always trash left behind and beer boxes from the partying there. Maybe posting no alcohol signs would make more sense. It's the partying that's the real issue, not trespassing from those that want to fish or have kids playing in the creek.

If anyone has an run-ins with the law, let us know. Otherwise I see no reason why I can't fish the lake

So what does anyone think about the chances of either (A) asking the AG's office to address the issue of a private HOA impeding a Missouri navigable waterway, or (B) looking into a private civil suit against the HOA to remove the boulders alleging that the paint on them presents a potential environmental hazard, and creates an unnecessary risk of injury for those navigating the waterway?

I've never fished that far up, nor been to this park of the river so I haven't seen it for myself. However, I am deeply opposed to this. Especially since the Sheriff's Office helped create it. According to this article:

Might be worth dragging the Sheriff into a suit as well.

So I have never fished linden before or the been to the area that is been spoke but it sound similar to what they did down at riverdale. It is almost impossible to any fishing or put your boat in the water there now...has anyone been fishing at linden in the past 30 days? jus curious if they had any trouble...Im interested to see how this plays out...I understand wanting to get the bad apples out but trying to ban everyone is rediculous....

The ford at Linden is the uppermost float access listed in my float book. From the tone of the articles, the property owners dont want folks partying and swimming. Show up with a fishing rod & a stream team bag on your belt. Pick up some trash. I bet that they leave you alone. Maybe put in above and float down through if its big enough.

I agree with Gavin. It is easier to just say no tresspassing than a sign that says "no toddlers in dirty diapers throwing rocks, hot dog campfires, loud stereos, rope swings, jumping off of the dam, mullets, beer cans, cut-off jean shorts, etc. I understand where they are coming from, but this is really frustrating. I enjoy catching smallies and goggle eye there when I don't feel like driving an hour or two to a lake. It's a relaxing spot. I don't go in the summer for the reasons I mentioned. There is nothing like slaying 40 goggle eye until you are tired of realing 'em in. (All thrown back, of course). It is really hard to find good river spots in the summer where people aren't screaming and getting plowed on Busch Lite. It would be nice if there were some designated fishing only areas along the James and Finley. Oh well. I feel better now.
