  6. Loved the video! That is also my favorite river. I didn't have time to check it out real thoroughly, but I liked your blog too. I will get into it a little deeper tomorrow.

  10. Well I am glad I had a positive impact with my phone call. And you can pm me your email our just click on the picture and then when you are on the screen of that pic only just right click and "save image as". I like that pic as well and also the two pics of Hopper I got.
  11. Thank you. I had a lot more colorful and descriptive report typed up but luckily in the time it took me to find my misplaced camera for the pictures I talked to the sheriff as did Duane and Chief and had time to cool off so I retyped it andtoned it way down.
  12. It is my interpretation of the law - and it very well could be wrong - that your scenario would be illegal. The verbiage "were purchased by legal means and there was a legal paper trail" indicates they were bought legally e.g. from a fish farm and there was a paper trail to support it. This is my interpretation of the verbiage and it may be as far off as my interpretation of the law may be. To the topic of someone draining a pond and selling the fish. That in my eyes is legal and sensible. The person built the pond and stocked it. Or even if the MDC helped in stocking I am pretty sure it would still be legal although I would take exception to it just the same as the MDC partnering with a landowner to stock a pond and the land owner not allowing anyone to fish the pond*. Anti flame asterisk: *Of course I know they aren't required to let anyone fish there pond, MDC only requests that the pond see reasonable usage, nor am I saying I or anyone else should be entitled to fish anyones private pond.

  14. Chief, the one with the warrant, met with the sheriff yesterday and cleared the air. He was not arrested and in no legal trouble. In my phone conversation with the sheriff on Monday, Chief's meeting with him yesterday and forum member DuckyDoty's phone conversation with him we all concur that the sheriff is not the issue. He stated we were all legal and that he would protect our rights just the same as the land owners. He seems very competent and well versed in the law regarding stream access. He is a man that uses his noggin as you put it.

  17. Where could one have a good chance to site fish to either of those flavors of gar around here? I bet they would kill these flies!

Kevin, do not quote me on this - and Al Agnew and others that have more experience and have done more research may chime in - but I believe the property below and on the right of way of the bridge to be public. Like I said I may be wrong and will stand corrected if I am, but I think you would be legal. Also, as pointed out as per the Missouri Supreme Court ruling in Elder v. Delcour it is very legal to be on the gravel bars of navigable streams. But as is also outlined local law enforcement (and even more commonly land owners) may be ignorant to this law. And we were warm water fishing (bass goggle eye etc) on this trip. Even though trout is my species of choice to target, the tig is the drug!   20. I concur but am somewhat unsure where to start. I am all for placing a few phone calls and carrying on a civil conversation in regards to this as I did with sheriff Copeland. Any ideas where to start?

  23. Site your sources (statutes, docket numbers from prior rulings, a link from the MDC site etc) or quit spouting your opinion as law.
