13 Lb Brown Landed Oct 1 @bssp

I saw this story on Weavers Site: Weavers Fishing Report

Shown above is Jack Buchschacher with the 13# brown he caught on October 1 (see "Our Previous Report" below for more details). The fish was caught in Zone 3 on a yellow soft plastic scud imitation that he ties himself. We did not have a picture or information on what was used to catch the lunker brown in our last report, so that's the rest of the story.

Congrats to Jack on catching/landing this nice fish.

As you can see in the info he used soft plactic. So here is my question:

Since Zone 3 is Natural bait and Plactics, is "Foam" legal in Z3? If so, does that make a fly like the a Foam Bettle legal, since it is make out of foam and thread only?

I thought as per previous discussions as to what is legal that in zone three the pertinent part of what describes a fly in the definition was (paraphrasing here) "otherwise permanently attached."

Trout Fishing Regulations

Zone 1

From the hatchery dam upstream to the end of the area. Only flies are permitted.

Zone 2

From the hatchery dam to the whistle bridge. Only flies and artificial lures are permitted.

Zone 3

From the whistle bridge to the Niangua River. Only soft plastic bait (unscented), natural and scented bait are permitted. All flies and artificial lures are prohibited, even if natural bait or scent has been added.

So once again we have to define what is not a fly or artificial lure so that we can be shure that one is not breaking the law.

dough bait, putty or paste-type bait, any substance

designed to attract fish by taste or

smell and any fly, lure or bait containing or

used with such substances.

(B ) Soft plastic bait (unscented)—Synthetic

eggs, synthetic worms, synthetic grubs and

soft plastic lures.

© Artificial lure—A lure constructed of

any material excluding soft plastic bait and

natural and scented bait as defined in (A) or

(B ) above.

(D ) Fly—An artificial lure constructed on

a single-point hook, using any material

except soft plastic bait and natural and scented

bait as defined in (A) or (B ) above, that is

tied, glued or otherwise permanently

attached..

Now with out the big words I take all that to mean you could fish a "scented soft plastic scud" as long as it is not tied or permanently attached to your hook.

Jack was using a "Fly" because it was "permanently" attached. So he was illegally fishing in Z3 when he caught this fish. Am I correct or am I reading the regulations wrong?

I have edited and reedited my post several times before checking for responses. Sorry for any confusion.

But I would not go that far as to say he did anything wrong simply because there is not enough info. About "If" his "bait" was permanently attached or not. I believe Brenda from Weaver's simply used the word tied in a very general sense and might have possibly picked a better term such as makes or designed.

Seiously though, very nice fish.. That definitely looks like the Suzy hole. How in the world did you land it between all those lines and legs? I can never seem to elbow into that hole, it's always chock full of anglers and powerbait!

Most of the browns I've caught over the years have had some reddish-orange spots on them.

I notice lately, that alot of them don't.

Doesn't appear that this one did either.

Are there different strains being stocked?

Nice fish Jack Good timing too ! only "legal" for a few more weeks. I hope she got released though.

Wonder how long before plaster of paris, ceramic paint, marmilade Mann's jelly worms, and little micro-wave ovens will be available through Feathercraft ? LOL

First off I would like to say Congrats to Jack!

I've known Jack for over 30 years and I know the particular" fly" that is in question. With out giving out any of his secrets, I can quarantee you that it is a legal bait for zone 3. Jack is one of the original pioneers of the art of sight fishing in Missouri trout parks. He's been at it for over 40 years now. This fish is one of several, 10 to 16 pound fish, that Jack has caught in the trout parks over the past 40 years. After the regulation changes for zone 3, Jack has designed several baits that work effectively. This gentleman has a wealth of knowledge when it comes to catching large fish. Jack was the very person that inspired me to become a sight fisherman. In 1975, I witnessed Jack landing his 100 th lunker. At that point, I decided that "my" goal, was to try to catch 100 lunkers. I would like to say thanks to Jack and several others for showing me art of sight fishing.

I think Jack was THERE (in the room) during the time that all the discussion on changing fly/lure/bait descriptions (wording) were being debated and decided on. He knows what's legal and what's not. It was without a doubt a "legal" catch...providing it was hooked inside the mouth.
