The landowner appears to be right to a point in the gray area, but what harm does it do to the county's reputation and economics to keep a foot off of a shoal or the bottom of a creek? Beyond that there is also the mysterious top gun, why was he there? Did the landowner send him to scare everyone off? I find it strange the he disappeared when things apparently got interesting. I also think the county has an obligation to warn people who want to float this section that they could be in danger of legal action. They put up speed limit signs, trash signs and other signs warning people, but how many people know you can't pull your boat through a shoal or step on the stream bottom on parts of Shoal creek? Guest P. owensby Posted April 20, 2011 Posted April 20, 2011 I'll be breif and conquer will all the above statements in reguards to the topic at hand as it pertains to the issue about Shoal Creek and any other waterway that is as so clearly floatable as Shoal Creek obiously IS, and the fact that the said incident in question happened between TAXPAYER ASSISTED MDC access points is absoulutly horrid. I thought that this was cleared up 57 years ago but apparently not, which is most disconcerning when it comes to this issue, especially when it comes to a waterway such as the size of the stream in question. Shame on you Mr. Prater ( I believe you're name is )& anyone else who subscribes to an obiously wrong philosophy when it comes to this situation. I, Paul Owensby, taxpayer and MDC licsense holder demand that the law as is states be upheld and certain action be taken so that such a breach of public trust and misreprsentation of said rights never be diminished again.
Members yakfisher Posted April 20, 2011 Members Posted April 20, 2011 I believe that if someone interferes or harrasses with a person fishing within the banks of a stream or river that has been accessed by way of a public boat launch put in by the Missouri Department of Conservation, then the harrasser/interferer should be punished to the fullest extent of the law. The state of Missouri has laws in place to keep this from happening and yet it still happens all the time. The only way to stop this type of harrassment and intimidation is to punish the law breakers. This stream, Shoal Creek, has obviously been deemed navigatable by someone in the higher powers of the states government, or the MDC would not have put in, not just one, but five public boat launches on the stream in order for the public to navigate, explore, fish, and clean up trash and debris on the stream. flytyer57 Posted April 20, 2011 Posted April 20, 2011 As a resident of the State of Arkansas and the holder of an annual out of state fishing license for the state of Missouri, for which I paid $49, I am shocked to hear that people who fish the waters of the far southwest counties of Missouri are harassed by armed landowners and law enforcement officers. Having purchased an annual fishing license for the state of Missouri, I plan to fish several of Missouri's streams and lakes. During my trips to Missouri, I will purchase tackle, food, lodging and gasoline. Although after reading about how anglers and floaters of the streams in the far southwest counties of Missouri are treated, I hold reserve to venture to that part of the state. The Supreme Court of the State of Missouri, in Elder vs. Delcour, has granted the right of floaters and anglers to float certain waters in the state without harassment. If local law enforcement agencies and the District Attorneys of the counties of southwest Missouri will not uphold this decision, I cannot see spending my money in said counties and will fish elsewhere. ness Posted April 20, 2011 Posted April 20, 2011 I think if we all go at this with the "...harasses with a person" language in there, we're hurting the cause. I also think a cut-and-paste web forum thread is probably not as effective as either a letter or a phone call directly to the people that can make a difference in this. I think about 25 calls to the Newton County Sheriff's office asking about the floatability of the stream, the rumors of gun-toting landowners running off legal floaters, and a little humble 'what's a feller to do, I think this is legal' or, 'we were planning our family reunion there next month' act, would have a much greater impact. I think I'll give Sheriff Ken a call tomorrow and get the ball rolling. Maybe ask him where this Prater guy lives and ask if I should just stay away from there or pack some heat when I go down, just to even things out. John
