Members Toby from MO Posted January 8, 2009 Members Posted January 8, 2009 After you catch your limit...you have them in the boat...do you have to stop fishing for the day? Obviously, you can't keep anymore but can a guy continue to catch and release?
soggyfeet Posted January 8, 2009 Posted January 8, 2009 I dont belive so. But I did noticed you posted this in the upper tany section so you shouldnt have to worry about keeping two many up there. Most of what you will catch is going to be in the slot(12 to 20) range. I think what people do is keep three and fish till they are ready to go in then catch one more to finish out the day. Dont be surprised if a bunch of people get on here and complain about keeping any fish at all. I think some peole think they are their pets. Brian
Members Toby from MO Posted January 8, 2009 Author Members Posted January 8, 2009 Thanks SF, I posted this in the "upper" section due to I'm gonna be fishing above the bridge, for the most part. I'm not refferencing the area above Fall Creek specifically but just asking a question "in general" regarding daily limit. To be honest we'll not likely venture above Fall Creek all weekend. Thanks.
Terry Beeson Posted January 8, 2009 Posted January 8, 2009 NOPE... Once you have your limit (this is true in MO and AR and I'm certain any other state) and you bring another fish to hand, even if you intend to release, you are considered over the limit. And even if you just keep fishing, you are considered illegal due to the fact of your "intent" to take another fish. Ham Posted January 9, 2009 Posted January 9, 2009 Sounds like a reason for some civil disobedience. I wish I liked the way trout taste because I sure wouldn't feel bad about keeping a limit. I'm just too tender hearted to kill smallies and spots. Give me a 12 inch min on Largemouth bass and I'll keep a limit a trip. I need to learn how to catch crappie up here. bigredbirdfan Posted January 9, 2009 Posted January 9, 2009 Just go back to your lodge, tent or camper and fry up a mess at lunch time then head back out for the afternoon. Opps I forgot they might be watching you from Plane, trees or satellite. Better not do that unless you are
Root Admin Phil Lilley Posted January 9, 2009 Root Admin Posted January 9, 2009 Sorry guys... we've covered this before. I talked to Toby last night and told him what the agents have told me. You can keep fishing if you have a limit of trout in your possession. Once you've caught and kept your 4th trout, you can't keep anymore even if you release one.
Micheal Kyle Posted January 9, 2009 Posted January 9, 2009 Phil you mean you CAN'T keep fishing right? It says it it right in the reg book once a limit of Trout is caught and kept you must stop fishing for all species. To Know People Is To Know Thier Ways!
Root Admin Phil Lilley Posted January 9, 2009 Root Admin Posted January 9, 2009 Quinton told me a person who has 4 trout in his possession can keep fishing. I made sure he understood the question. I've asked him on 3 different occasions and the answer is the same.
Root Admin Phil Lilley Posted January 9, 2009 Root Admin Posted January 9, 2009 (3) Limits and Possession. A Any species taken into actual possession, unless released unharmed immediately after being caught, shall continue to be included in the daily limit of the taker for the day when taken except as authorized in subsection (3)(E) of this rule. B A person may possess only the daily limit of any species while on the waters or banks thereof to which the limit applies. C Regardless of where taken, no fish less than the specified minimum length limit shall be possessed on the waters or banks thereof to which length limits apply. The head, tail and skin must remain attached to all fish for which length limits are established while those fish are on the waters to which length limits apply or until the fish have been checked by an agent of the department.
