I've got a question about limits.....Say you started fishing at 10 pm and caught and kept your daily limit of 4 fish by 11:59 pm, could you start fishing and keeping another limit of fish at 12:01 am to fill your next daily limit and possession limit of 8 fish all being on the same stringer???

I don't see anything different in the trout section that says anything different pertaining to possession and release.

I just got off the phone with the Southwest Regional Protection Supervisor he said that if you have 4 fish in your possession you have to take the fish into a designated location.(ie cooler, lodge,house) where ever you can keep them separate. If you keep them on your person or in your boat you have to stop immediately. If you have 4 fish on you or in your boat and you are C&R you are in violation and will be issued a ticket.

So it is simple catch your 4 fish put them in a cooler then go back and fish C&R only. That is the only Legal way to do it.

It's not in the code book... go to the code book and backup your statement -

It says it it right in the reg book once a limit of Trout is caught and kept you must stop fishing for all species.

Yep, page 16 of the regulations guide states that you must stop fishing for all species once you have caught and kept your limit.

Guys, this isn't getting any clearer.

Occasionally, there are those issues that we're told, "It's at the discretion of the officer."

Basically, you takes your chances.

Be safe.

If you want to keep fishing, don't keep that 4th one.

Once you string up or drop #4 in the livewell, you're done.

Simple.

Otherwise, you risk a nice fat fine.

Not worth it.

And the Judge ain't gonna accept, "Well...on ozarkanglers forum they said......."

Judge: "GUILTY. THAT'LL BE $200!" :huh:

Sorry Phil it is in the supplement and is under the parks so it may just be referring to Trout parks

I will say that it is the responsibility of each individual person to know what the law is and not to rely on some one else that says something.

In the past when I was working with the MDC and riding with agents they have written many tickets for this. I personally would not want to push the limits of legality. Mike Abdom who used to be the agent for Taney County and that was when the limit was 5 would write you a ticket.

Like I said in my previous post according to Southwest regional supervisor who is the head agent for this area, said if you have the fish on you and or your boat and are C&R you are in violation.

So maybe it is just up to the agent and how he/she perceives the law and how you treat them.

I have seen plenty of people that did deserve a Ticket not get one because they were nice to the agent kind of like getting verbal warning.

I started to weigh in on this earlier, but didn't since I wasn't sure about it. Phil, I think with your earlier statement that "Quinton told me a person who has 4 trout in his possession can keep fishing.", you actually meant to say you cannot keep fishing.

The rules and regs can be very confusing, and more so when they have different rules for different areas. It can be so confusing I think that even some of the agents may differ on exactly what the rules are. I was pretty sure that once you have your limit of trout, you have to stop fishing, and I don't think that unloading your limit back at your house or where ever will permit you to go back out for C&R fishing. If you already have your limit, and if a fish dies while still fishing, irregardless of whether or not you meant to release it, it counts toward your daily limit, that would then put you over your limit. At Mark Twain Lake I've known of agents tracking fishermen and knowing when they left the lake with a limit and then going back out for more fishing. A few times the agents would find out which hotel or resort the fishermen were staying and go in to check their freezers. One time a group of four guy's ended up with a $4,000.00 dollar fine. My wife and I used to own a business there, and fortunately we were never a part of any bust.
