It is a ethical question at best. It is only done with little or no generation and as soon as the generation is resumed the botom is filled back in. There are not a lot of people who do shuffle and if it someone enjoys catching fish with this approach it doesn't have to affect your attitude. There are enough trout for everyone. I wonder what a law stating you can't fish within the minimum reach of you fishing rod, extended parallel to the water, would do. It would certainly keep your fly out of the feeding area and make shuffling somewhat useless. Today's release is tomorrows gift to another fisherman.
