ColdWaterFshr Posted May 5, 2011 Posted May 5, 2011 Its confusing because the paragraph I cut and paste talks about "frontage" being private property. Frontage is the bank immediately adjacent to a stream, is it not? No mention of gravel bars, high water marks, or any language that would approach the notion of an "easement". MDC's link on trespassing is not a legal statement in any way, shape, manner or form and they would probably be the first ones to tell you that, hence their repeated disclaimer about asking for permission. Nobody is denying that going up in the field and throwing down some tents would be trespassing, but exactly what point is the high water mark? High water as in the floods of last week? Floods of last fall? Is this imaginary line in flux? MDC's link doesn't define JACK and that is by their own design. They want to avoid involvement. I too am looking forward to this Prater dude exploding when the outfitter puts in 100 canoes on the first nice weekend of the season.
snagged in outlet 3 Posted May 5, 2011 Posted May 5, 2011 I feel ya Pdiddy. So if we combine both paragraphs, as long as we access the river legally and as long as we stay in the water we're legal. Your honor, your honor. SIO3

Your honor, your honor SIO3 But if this were the case then landowners could just obstruct the stream and then make you paddle your butt back up to the public access! That can't be right, eh? cricket.c21.com
FishinCricket Posted May 5, 2011 Posted May 5, 2011 I'm kidding guys!!!! just bored at work..... Good to know whose anus crosses your mind when your bored at work.. But didn't you say you're bored relatively often? :shudder: cricket.c21.com
Outside Bend Posted May 5, 2011 Posted May 5, 2011 But if this were the case then landowners could just obstruct the stream and then make you paddle your butt back up to the public access! That can't be right, eh? Not if the landowner's obstruction is interfering with anglers and recreationalists' right to use those streams, right? <{{{><
snagged in outlet 3 Posted May 5, 2011 Posted May 5, 2011 Look at post #70 Cricket. Portaging is legal. Man I need a fishin trip. Golf just isn't cutting it lately. Pete
eric1978 Posted May 5, 2011 Posted May 5, 2011 ...pretty mouths and tender anuses... I think the plural of anus is "ani."
ozark trout fisher Posted May 5, 2011 Posted May 5, 2011 This thread is the first time I have heard the account in full. And I am more convinced than ever that I did the right thing signing this petition, though apparently some feel otherwise. I have strong feelings against folks that try to control navigable streams.
ness Posted May 5, 2011 Posted May 5, 2011 Look guys, I thought we had been over this before. Time and time again. But maybe not, or maybe that was another forum. Please read this entry from Wiktionary carefully: anus (plural anuses):(anatomy) The lower opening of the alimentary canal, through which feces are ejected. So, it's not ANI! Never was, never will be. Phil, Dano: please let me know if this anatomical language is too much for this family-friendly forum. I can convert it to baby talk ('bottom'), or British ('bum') to kinda soften it up some. Oh, and go take a look at post #56. John
