     New law got slipped by some of you might not know about. It might affect some of you that might own Tompson contenders adding a buttstock to your pistol. Any pistol in fact.  You will now have to add a 16" or longer barrel or become a felon.  Just some FYI to any here that tweak out your handgun. I know there are now AR pistols out there also that will have to be changed.   We all know there will be more laws coming in the future. I am not trying to stir the pot here and do not post something political here please. This is just a PSA for those that might not know this new law is here. The ones here on first link are not what typical hunters are using but the typical law-abiding hunter wanting to hunt with certain pistol platforms are not thrown into this mess,

Shhh.  That will be overturned soon.

I have 3 braced pistols that I made after the surgery that took out a piece of my right arm.  They are legally bought, approved by the MDC as alternative firearms to be used during the late deer season, and allow me to use a steady pistol capable of taking large game since the cancer.  The ATF sent letters out showing they were approved as legal several years back.  Then, they renigged on the deal and make a cloudy mess out of things to make people register their firearms as weapons of war and not sporting arms that they have been for these many years. 

But, since they never sent me a letter addressing the situation, I am not aware of any legalities of my  decisions.  I am not even sure we are talking about the same thing.........

      Just again fyi JD. Its written pretty clear and do what you want. Break the rules and become an instant felon. I didn't get a letter either but taxes go up and no letter either.

This is nothing but Lawyer food. 

Yes it's true that ignorance of the law is no excuse.   But it is also true that NO CITIZEN is required to read newspapers every day, listen to the news on TV every night...taking notes as if there's a test tomorrow.    Nor are they required to read their unregistered mail.

Laws on numerous things, such as firearms, can change with the prevailing wind these days.  

Therefore unless a law has been in effect for a decade or more then you can NOT be convicted of breaking it unless you're a total idiot and blindly enter a plea.   Or have recently signed something stating that you acknowledge that law.

ATF Federal Firearm Ruling.  They are the branch of the Federal Gov that regulates firearms, alcohol, and tobacco.  They make rules for firearm manufacturers, importers, dealers, owners.

Current administration using them to find ways to make legal gun ownership harder and more profitable for them.

What part of that is not confusing??   I cut out the part that defines the new rule and added my underlined build that defines the configuration that I have.  The intent of the brace was to stabilize firearms for use by Veterans of the US that have been disabled.  My disability was the result of surgical procedure to procure necessary replacement for the tongue that I lost.  I still have full speech, but it has lessened the use of my right arm.  Second surgery when the cancer returned cut nerves on the shooting  shoulder that prevent me from firing shoulder firearms comfortably.  The way I read it, my brace is still legal and does not need any other regulation.  But, they really wanted me to submit the firearm for their inspection to see it its legal.

Accordingly, the Department amends
the definition of ‘‘rifle’’ under 27 CFR
478.11 and 479.11 to expressly state that
the term ‘‘designed or redesigned, made
or remade, and intended to be fired from
the shoulder’’ includes a weapon that is
equipped with an accessory,
component, or other rearward
attachment (e.g., a ‘‘stabilizing brace’’)
that provides surface area that allows
the weapon to be fired from the
shoulder, provided other factors, as
listed in the amended regulations and
described in this preamble, indicate that
the weapon is designed, made, and
intended to be fired from the shoulder.
The other factors are:


(1) Whether the weapon has a weight
or length consistent with the weight or
length of similarly designed rifles;

Its heavier than my 380 bodyguard, but I am using this one in lieu of a blackpowder rifle which affects my surgical induced recoil issue on right hand shooting shoulder.  MDC allows braced AR pistols during the alternative season.  Its still defined as a pistol, not a SBR.


(2) Whether the weapon has a length
of pull, measured from the center of the
trigger to the center of the shoulder
stock or other rearward accessory,
component or attachment (including an
adjustable or telescoping attachment
with the ability to lock into various
positions along a buffer tube, receiver
extension, or other attachment method),
that is consistent with similarly
designed rifles;

The length of pull places the blade of the brace against my inner forearm for support.  The blade brace is tilted slightly in to angle for better support on the firearm shoot steadily.


(3) Whether the weapon is equipped
with sights or a scope with eye relief
that require the weapon to be fired from
the shoulder in order to be used as
designed;

All of my pistols have red dot optics, no magnification and long eye relief.  No short eye relief scopes.


(4) Whether the surface area that
allows the weapon to be fired from the
shoulder is created by a buffer tube,
receiver extension, or any other
accessory, component, or other rearward
attachment that is necessary for the
cycle of operations;

I could shoulder fire using only the standard pistol buffer, the thin blade does not offer any additional "rifle type of support for cheek or shoulder".


(5) The manufacturer’s direct and
indirect marketing and promotional
materials indicating the intended use of
the weapon; and

I made it, assembled it from legal parts and intended on using it as a pistol for hunting purposes.


(6) Information demonstrating the
likely use of the weapon in the general
community.

It is a sporting handgun legally made and used for hunting purposes.


All of the objective design features
and factors listed in the rule that
indicate the weapon is designed, made,
and intended to be fired from the
shoulder are derived from the NPRM
and proposed Worksheet 4999.
The revised definition in this final
rule clarifies, consistent with the best
interpretation of the statutory provision,
that firearms with an attached
‘‘stabilizing brace’’ can possess objective
design features that make them ‘‘rifles,’’
as that term is defined under the NFA
and GCA. If a firearm with an attached
‘‘stabilizing brace’’ meets the definition
of a ‘‘rifle’’ based on the factors
indicated in this final rule, then that
firearm could also be a short-barreled
rifle depending on the length of the
attached barrel, thus subjecting it to
additional requirements under the NFA
and GCA. However, a firearm with an
attached ‘‘brace’’ device is not a ‘‘rifle’’
as defined in the relevant statutes if the
weapon is not designed, made, and
intended to be fired from the shoulder.
The rule, as proposed and finalized,
does not ban ‘‘stabilizing braces’’ or
prohibit firearms with an attached
‘‘stabilizing brace,’’ regardless of the
firearm’s classification.
