Blazerman Posted January 13, 2017 Posted January 13, 2017 The first thing we were taught in the CC class is if you end up having to pull and use your firearm and were correct in your assessment of the situation and were 100% justified, you will more than likely still be sued civilly by the dirt bags relatives because there are scumbag lawyers out there that make a living doing that. And they will sue you for whatever they can get and the laws are very murky on the civil side. You might be fine with no laws broken and no further action taken by law enforcement but will spend many $1000s of dollars defending yourself against the civil lawsuit even if you win.

MOPanfisher Posted January 13, 2017 Posted January 13, 2017 The only thing for sure is that you can never tell what a jury might do, they might laugh a civil suit out of the court but you will still be out attorney fees. Especially if it happens outside your home area you can't even guess what a police dept. Might do. If I were in a shooting here at my home, am pretty sure the Sheriff would not arrest me unless something was way off. If I were in springfield or heaven for bit St. Louis, I don't know. Fortunately there are very few reasons I would be willing to kill someone, and they all have names and are pretty dear to me. Old plug 1

Some ones daughter (probably) was murdered and then dismembered and burned in a public place. Its not about you and your weapon. Yet another sad story with a predictable ending. Forensics report say it was a dismembered male between 5'8" and 6'2".
evilcatfish Posted January 20, 2017 Posted January 20, 2017 Probably no connection, but still... http://www.stltoday.com/news/local/crime-and-courts/body-found-in-river-in-franklin-county/article_f47a2790-bdde-530c-98f2-ebe47d7ca096.html
Members Ffer Posted January 22, 2017 Members Posted January 22, 2017 Don't remember how long ago it has been , but someone else was murdered at the same access. Our family had a clubhouse on the Bourbeouse across the river from that access before the flood got it.

I am fairly certain this was the case back when I took my certification course, but "Castle Doctrine" and "Stand Your Ground" have changed the game. Current MO Revised Statutes regarding justifiable use of force- if your use of force was legally justified, such justification provides an absolute defense from civil liability. "Justification as an absolute defense, when. 563.074. 1. Notwithstanding the provisions of section 563.016, a person who uses force as described in sections 563.031, 563.041, 563.046, 563.051, 563.056, and 563.061 is justified in using such force and such fact shall be an absolute defense to criminal prosecution or civil liability. 2. The court shall award attorney's fees, court costs, and all reasonable expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant has an absolute defense as provided in subsection 1 of this section." It looks good on paper, I pray I never have to find out how well it works. bkbying89 1
