Or should IMO. You can't just stand there and provoke someone with confidence because you have a glock at your disposal. But I'm not opening that can of crap again.

I read somewhere where the regulation were meant to spell out what you can do not what you cant do. In the case of a snagging gamefish violation there is always going to be one thing that is hard to prove..... Intent.

Intent should have nothing to do with it. Whether you meant to snag it or not it should be illegal to possess it. It's really pretty simple. This is a sore subject for me because I got burned in a tournament with this. A guy that admitted that he had "accidentally" snagged a 6 pound fish was allowed to weigh it in because he did not purposely snag it. He won the tournament and big bass. Even several protests filed with the tournament director were ignored. I was one of the ones that protested and the director knew it was wrong and would not make the call. He told me that it was my call. That was so wrong to me, I was just a guy fishing, why was he allowing me to make the call on whether or not I got a check. I told him he was a POS and went home. And this was no ordinary 6 pound Table Rock bass. It was half dead with sores all over it and blind in both eyes. I had seen it earlier in the day and actually netted it and put it in the boat just to look at. So we knew that fish when it showed up on the scales with the snagging story. Found out later that the guys that weighed the fish was a client of the Tournament Director who happens to be a well known guide on Table Rock. If a fish is snagged you need to be a decent human and put it back. Â Â

laker67 Posted March 7, 2014 Posted March 7, 2014 I forgot to add that it does not matter if it was snagged by accident or otherwise with intent. Immediate means before pictures, before weighing or measuring, and certainly before hauling it back to a tournament weigh in. That director was as much at fault as the snagger. They should both have their fishing permits withdrawn for 5 years like other criminals.

In today's meta where there are 10's of thousands of C&C permits floating around, any violence directed at another person is likely to be met differently than it was 10 years ago. -Jerod
Wayne SW/MO Posted March 7, 2014 Posted March 7, 2014 It's moot when it comes to fishing the outlet however. Even though they know the odds of snagging a trout are high, or they should know, the fish aren't seen, aren't "deliberately" snagged, and they are released. The problem I have is with the injuries to the fish and the blatant non fishing of it. Lets face setting out to snag any fish you can catch in the mouth isn't fishing. Today's release is tomorrows gift to another fisherman.
