some excerpts that apply;

"A person may possess only the daily
limit of any species while on the waters or
banks thereof to which the limit applies.

(F) A person may possess no more than
two (2) statewide daily limits as prescribed in
3 CSR 10-6.505 through 3 CSR 10-6.620.

(35) Limit: The maximum number or quanti-
ty, total length, or both, of any wildlife per-
mitted to be taken or held in possession by
any person within a specified period of time
according to this Code." 

This says to me that the possession limits specified only apply at home or in transit, but don't apply on the   body of water or banks, there the daily limit is all you can possess, even if it takes a week to catch that many.  So, once away from that water and bank the state wide rule of "two (2) statewide daily limits" applies.

Wildlife may be given away if properly labeled and  then becomes part of the possession limit of the recipient, I found nothing saying that the recipient of a gift needs a permit nor anything saying  that a church could not be such a recipient.  I guess then that a 300 member church could possess 600 daily limits so long as the labels are in place?

Well I thought I had a solid understanding of all the rules and regulations, but I learned something here regarding the possession limit, I think.  Better to be on the safe side though.

My wife and I where down there over the weekend and I have to say I was very disappointed in the amount of folks we would see catch their limit of the morning and would see the same group of folks out in the evening catching another limit and that would continue each day

I am still curious if the consensus of opinion is that is legal to sell wild caught trout (or any other gamefish) up there in Missouri.

Only if they are farm raised.  Assuming you mean actual Missouri fish, not something commercially supplied from other states, countries etc.

Sale of any wild life or parts are prohibited by:

3 CSR 10-4.110

(1) No bird, fish, crayfish, mussel, amphibian,  reptile,  mammal,  or  other  form  of
wildlife, including wildlife raised or held in
captivity,  or  their  homes,  dens,  nests,  eggs,
and larvae in Missouri shall be molested, pursued, taken, hunted, trapped, tagged, marked,
enticed, poisoned, killed, transported, stored,served,  bought,  sold,  given  
away, accepted,  possessed, propagated, imported, exported, or
liberated to the wild in any manner, number,
part, parcel, or quantity, at any time, except as

this Code  shall  not  apply  to  other  invertebrates
except as specifically provided.

 Sales of wildlife and Commercial permits are governed by 3 CSR 10-10.705 thru 3 CSR 10-10.787 and i see no mention of trout  as a commercial fish.

Under Confined Wildlife, 3 CSR 10-9.640 and CSR 10-9.645 govern Licensed Trout Fishing Areas

None of the above say that I can sell game-fish.

Is it legal or not?

4$ for a trout!!!   You can get the same flavor profile from the pellet machines for a quarter a handful at the hatchery.  And you don't have to clean a trout.

Apparently it is illegal which is great news. So does anyone know if MDC has given this guy a citation or at least shut his operation down?
