In a sense he kind of got a bad deal, ya I reckon he is liable, he was there in charge, your boss tells you to do something , you better do it, it's not his fault he wasn't trained properly, the family of the deceased should have a legal case against the state maybe, It's all about the mighty $$$$

The mistakes he made (can't believe we are calling them MISTAKES....but whatever) were nothing that extra training could have prevented.  Someone with no training at all should know better.    The dude is a jackass and he was just in a hurry to get Brandon booked so he could get back out there and rack up another arrest.   The dept. offered incentives and Piercy was the lead dog on DWI/BWI.    Now we know how......Cutting corners.

This topic always seems to get to me.  Whether or not the kid was drunk at this point is somewhat irrelevant, he was in custody of the MSHP and due to a failure on the officers part the kid died.  It was not a freak accident, or simple bad luck, it was the officers fault plain and simple.  He was responsible for properly and safely transporting his prisoner.  Simply putting life jacket on correctly would have resulted in a wet, maybe bruised but LIVE prisoner.

Having been here in the area with this Smart butt I can almost discribe what happened.  

He seen the boys. Knew they more than likely got served in the bar. His job

He comes up and says he is going ro make a check. His job

The  boys in the boat get arrogant  Their fault

He takes the boy in the boat blows his cool something he was good at. 

Does not use the on site alcohol tester. Gets further pissed at the unrully bunch bowls his cool  because he wants to get him down there to the jail house where he can charge him with all sorts of crap. 

He is ao mad he cuffs him behind his back throws the ski cest over him in his rage

Sets him on the little consol seat. Puts the hammer down and goes flying into into the traffic lanes at a high rate of speed. 

Then the bouncing from gitting those traffic wakes threw the boy off the seat he stumbled to get his balance  and he attempted to  avoid  going overboard by putting his foot  on the gunnel  but went . well he did and he drowned

After he drowned they have a recording of piercys first words.  " I wont lose my job over this will I boss" " Then he tell him I tried to save the S O B" . He also said the kid was trying to jump out of the boat. the spot where he drowned is not really very wide in relation  to lake around it. I am sure the wakes ther were tremendous. .  Yet in his anger and abd lack of good jugement he  tried To go through full blast. Its a wonder they did not both go over. That boat must have been jumping like a jumping beanI feel no sympathy for him. I watch them pull  the body out of the water. To me it is  the crowning development it the  guys carrier attitude. 

Whos fault was it then?????  ALL OF THEM have some guilt in it. From the person who served them drinks  to his buddie drunk harrassing to Piecy and piercys attitude and personality. He should never have been wearing the uniform.

Since the other thead on the drowning is still active I am going to go back to the OP and the combin ing and possible splitting of the MSHP and MSWP.  We as taxpaying citizens (myself included) are always complaining about waste in the government and that it needs to be more efficient.  The original concept of combining the two state LE agencies made perfect sense, why have 2 separate systems for payroll, purchasing, vehicles, equipment, retirement etc.  Unfortunately as sometimes happens a perfectly good concept was destroyed, whether by intent or incompetence, it is still easily saveable if the MSHP and legislators will get beyond the "react" phase and move into "act".

In my limited experience, the Water Patrol has a lot of "cowboys".

I have 2 good friends that are with MSHP, one is a Captain.

The men & women of the MSHP were not happy that they were combined, and feel like the image and caliber of the group was dragged down with the addition of the Water Patrol.

My experience has been the exact opposite.  Every MSWP officer I have ever worked with from Captain down to patrolman have been the salt of the earth, it's been some of the MSHP guys that have had the attitude of "we are special".  Either way the combination was very poorly handled, the regular MSHP guys had no clue how to integrate water patrols into their way of doing things, and they had pretty well weeded out most of the experienceed WP guys who did understand how to do it.  The MSHP seemed to believe that driving a boat around was a cake job and literally anyone could do it, they have since learned differently.  Operating a large patrol boat of busy waterways or a small boat in flood conditions is not a simple job.  I get the privilege of having the MSHP do their swift water swim and boat training here below the dam.  It is a major learning experience for many of them and the instructors are VERY good operators.  I would think that the MSHP would certify officers for water duty sort of like SWAT program.
