Drunks and boats/lake don't mix well....as far as demographics looks like the LOZ and casino crowd....perhaps if the pic you posted is the size crowds they have, I won't have to worry about them saying in business long......

Bald Eagle Conservation Measures

Measures to Avoid Disturbing Nesting Bald Eagles During Recreational Activities

None of these activities will disturb eagles if conducted during the non-nesting season. In the upper Midwest (Illinois, Indiana, Iowa, Michigan, Minnesota, Missouri, Ohio, and Wisconsin) the nesting season is generally from late January through late July and the non-nesting season is from August through mid-January. The following measures only pertain to the nesting season. 

 

See the Bald Eagle Natural History and Sensitivity to Human Activity document for additional information. 

 

Non-motorized recreation and human entry (including hiking, camping, fishing, hunting, canoeing)

If you walk, bike, canoe, camp, fish, or hunt near an eagle nest during the breeding season and your activity will be visible or can be heard from the nest stay at least 330 feet (100 meters) from the nest.

 

None of these activities near a nest, would disturb the eagles if the activity cannot be seen or heard from the nest. 

 

Off-road vehicle use (including snowmobiles)

If you use off-road vehicles (and this includes snowmobiles) near a bald eagle nest during the nesting season stay at least 330 feet (100 meters) from the nest. In open areas, where there is increased visibility and exposure to noise, stay at least 660 feet (200 meters) from the nest. 

 

Motorized watercraft use (including jet skis/personal watercraft)

If you use motorized boats or jet skis near an eagle nest during the breeding season, to avoid disturbing the eagles and their young: 

 

(1) Do not operate jet skis (personal watercraft) or airboats within 330 feet (100 meters) of the nest,  

 

(2) Avoid concentrations of noisy vessels (e.g. commercial fishing boats and tour boats) within 330 feet (100 meters) of the nest, except where eagles have demonstrated tolerance for such activity, and 

 

(3) For all motorized boat traffic within 330 feet (100 meters) of the nest, minimize trips and avoid stopping in the area, particularly where eagles are unaccustomed to boat traffic.

Missouri boat noise law

Boats built on 1/1/96 or later must not exceed a noise level of 90 dBA when stationary at idle and measured from a distance of 3 feet,

and; all motorboats must not exceed a noise level of 86 dBA when measured from a distance of 50 feet.

      Good luck buddy! You know one of the biggest places where STD's are being spread now is nursing homes :) . Seen it on TV it has to be true!

I have no idea what grounds you would sue on, given that bald eagles were delisted from the Endangered Species Act ten years ago and a motorboat noise ordinance covers...motorboats.  Not docks or marinas or restaurants. If you can find a lawyer interested in either bilking you or losing cases, and if a judge doesn't laugh you out of the room, you're welcome to try.  But with the money, time, and energy you'll have wasted you could probably have just bought out the current owner and turned it into a monastery or whatever else you'd suits your fancy.

You're suggestion is an ineffective solution to a problem that doesn't exist.  It's not a good idea, just a different bad one.

Although eagles were removed from the endangered species list in 2007, they are protected under the Migratory Bird Treaty Act and as the national bird under the Bald and Golden Eagle Protection Act. Law requires a permit to remove or kill an eagle, or to disturb it to the point that it abandons its nest or changes its nesting behavior.

The group’s attorney, David Webster, if I remember correctly is the Oldest son of William L. Webster,  Bill was born and raised in Carthage, Missouri and was a graduate of Carthage Senior High School and Attended MSSU and University of Kansas, He received his law degree from the University of Missouri–Kansas City.

As a note Webster was/is an outdoorsman attended roaring river opening days..ETC.. ETC

Prob an option but I bet it gets way cheaper when litigation is in play......

I beg to differ!!!  Many that I talk too are not happy with a noisy bar on the lake... Complete with drunks/drugs/trash/etc that comes from business of that sort. Suggesting that is like saying LOZ has no issues with boat wakes.....ones playbook to seek an ends to a means includes litigation....
