Good 'catch' on getting those fish out of the barrel.  Bad thread derail on the smoking thing.  We don't need a law/regulations for everything.  If an establishment believes they can make more money catering to either smokers or non-smokers then they should be free to choose as I am free to choose not to be a customer of places that I don't like their environment.  Tread carefully when asking for more laws/regulations as they may adversely impact you at some future time.

Now back to discussing scurvy dogs that need to walk the plank for putting fish in a barrel.

Read a report yesterday about a Yak tourney guy cheating.  If your familiar with how their tourneys work, they measure then take pictures of the fish. He shortened his measuring device by 4".  Busted.  I just don't get cheating during fishing like I don't smoking, nor driving while intoxicated.  If you have to cheat fishing, then that tells everyone that you SUCK at fishing.  Take up watching golf on TV.

Here's my request.....  Don't listen, and don't breathe. :)

Y'all stand in a cloud of hairspray fallout probably every morning, sit next to your Sweetie's while they fill the room with nail polish fumes, sit in traffic behind diesel burners, burn leaves, sniff your gas cap when refueling, ect.  But then someone 40' away lights a cigarette and you loose your mind.    Gimme a break!

I only know of one guy that ever lost his mind when you lit a cigarette. You still taking him fishing today?? :)

Here's the problem with letting the market decide on smoking.  Though in theory making your establisment smoke-free should give you a competitive advantage, given that non-smokers outnumber smokers, in reality every restaurant owner is so afraid of losing the part of the customer base that smokes that none of them are ever willing to try it.  Nor do they have to worry about competition in that regard, because all the other owners feel the same way, so the non-smoker often has no place else to go.  When I come off the river and into many small Ozark towns with two or three cafes at most, chances are every one of them allows smoking, so I'm screwed, unless I want to drive 30 miles to the nearest major highway with a fast food joint at the exit.

And again, in some situations you don't have a choice.  Either there aren't any non-smoking cafes in the area, or you walk into one, order your food, begin to eat it, and THEN somebody a few feet away lights up, which for me ruins the meal, period.  Not to mention that my wife is highly allergic to tobacco smoke, making her choices severely limited in many places.  In effect, by "not telling you what to do (or in this case not do)", you are telling other people that they can't go places and do things.

Bottom line is, the no smoking laws work wherever they are instituted statewide, such as in Montana.  I was there when the law first went into effect, and there was a lot of complaining.  But a year later everybody was used to it, the restaurant owners loved it because they didn't get complaints from non-smokers, they didn't have to set aside no-smoking sections, they didn't have to clean the residue of tobacco smoke off the walls anymore or empty ashtrays and clean up butts and ashes off the floors constantly, and they didn't have to worry that the guy on the next street was getting all the smokers' business.
